In 1787, our founding fathers adopted the U.S. Constitution, which gave Congress the authority to enact bankruptcy laws to provide honest debtors a financial fresh start. Despite misconceptions, bankruptcy law has always been intended to serve a very positive purpose for honest people in hard times: “It gives to the honest but unfortunate debtor…a new opportunity in life and a clear field for future effort, unhampered by the pressure and discouragement of preexisting debt.” – The Supreme Court 1934.
